1. ELIGIBILITY: 2011 Memorial Day Weekend Sweepstakes (“Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia (excluding Hawaii) who are at least twenty (21) years old as of the time of entry. Employees of Palms Casino Resort, N9NE GROUP, FIJI Water Company LLC (“Sponsor”), and their parent and affiliate companies (collectively, “Promotion Parties”) as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to verify eligibility qualifications of the winners.
2. HOW TO ENTER: During the Entry Period, visit http://www.fijiwater.com/memorialdayflyaway/ and follow the links and instructions to complete and submit an on-line entry form. Limit one (1) entry per person/e-mail address/household for the duration of the Sweepstakes, regardless of the method of entry. Entries generated by script, macro or other automated or mechanical means are void. All entries become the property of the Sponsor and will not be acknowledged or returned. Promotion Parties and all of their respective employees, officers, directors, shareholders and agents (collectively, “Released Parties”) assume no responsibility for lost, stolen, illegible, corrupted, misdirected, incomplete, inaccurate, delayed, undelivered, garbled, postage-due or late entries, e-mail or for entries or e-mails that are processed, reported, or transmitted late or incorrectly or is lost or misdirected for any reason whatsoever nor for any other error, problem or malfunction of any kind, whether computer, network, telephonic, technical, mechanical, human or otherwise, relating to or in connection with this Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, processing of entries, notification of winners, announcement of the prizes or in any Sweepstakes-related materials, or for the inability to access any website associated with the Sweepstakes.
3. PRIZES: GRAND PRIZE (Approximate Retail Value: $2,500): Two (2) night stay (Saturday, 5/28/2011 & Sunday, 5/29/2011) for two (2) in a Standard Deluxe Guestroom at the Palms Casino Resort in Las Vegas, Nevada. Trip consists of: (a) round-trip, economy class air transportation from a major U.S. gateway airport near the winner’s residence (as determined by Sponsor, in its sole discretion) to Las Vegas, Nevada for winner and one (1) guest on Sponsor’s choice of airline; (b) All Venue Access wristband to Moon Nightclub, Playboy Club, Rain Nightclub, and Ghostbar; (c) hosted bar for two (2) for one (1) night (from 10 pm to 1am) at Rain Nightclub during the weekend of 5/28/2011; (d) dinner for two (2) at Nove Italiano; and (e) one (1) year home delivery of FIJI Water (consisting of one (1) case of 24 bottles of 500ml FIJI Water per month). Winner and guest must travel together on the same itinerary and are responsible for obtaining all required travel documents. All travel arrangements will be made solely by Sponsor with a provider of its choice, and are subject to the terms and conditions of such providers. Winner’s guest must be at least 21 years old and must execute and return a liability release and, where legal, a publicity release prior to prize award. Travel must be taken on dates specified by Sponsor or prize will be forfeited. Any prize components that are not utilized during stay will be forfeited. RUNNER-UP (Approximate Retail Value: $210): All Venue Access wristband to Moon Nightclub, Playboy Club, Rain Nightclub, and Ghostbar, and hosted bar for two (2) for one (1) night (from 10 pm to 1 am) at Rain Nightclub during the weekend of 5/28/2011; THIRD PLACE (Approximate Retail Value: $210): All Venue Access wristband to Moon Nightclub, Playboy Club, Rain Nightclub, and Ghostbar, and hosted bar for two (2) for one (1) night (from 10 pm to 1 am) at Rain Nightclub during the weekend of 5/28/2011. Total approximate retail value of all prizes: $2,920. All prize details are at Sponsor’s sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Runner-up and Third Place winners are solely responsible for their own transportation to Las Vegas, Nevada to redeem prizes and any accommodations. All winners are solely responsible for paying all applicable federal, state, and local taxes as well as any other costs and expense associated with the prize acceptance and use of any prize not specified herein as being awarded. Limit one (1) prize per person or household. Additional restrictions may apply.
4. Drawing: The potential winners will be selected in a random drawing held within five (5) days after the Entry Period from all eligible entries received. Odds of winning depend on the number of eligible entries received. The potential winners will be notified by mail, phone, and/or e-mail and may be required to execute and return an affidavit of eligibility, a liability release and, where legal, a publicity release within seven (7) days of date of issuance. If such documents are not returned within the specified time period, prize notification is returned as undeliverable, or potential winner is not in compliance with these rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected. If a potential winner is disqualified for any reason, or if any potential winner refuses their prize, at Sponsor’s discretion, the prize may be awarded to an alternate winner. Further, Sponsor reserves the right to forfeit or award any unclaimed or leftover prizes at its sole discretion. Acceptance of prize constitutes permission for Sponsor and its designees to use each winner’s name, city, state, likeness, voice and biographical information for purposes of advertising, promotion and publicity in any and all media, now or hereafter devised without limitation and without additional notification or permission or compensation, unless prohibited by law. All information collected will be treated in a manner consistent with Sponsor’s privacy policy and the consent given at time of entry. The Sweepstakes is governed by the laws of the State of California, with venue in Los Angeles, California, and all claims must be resolved in the appropriate state and federal courts of Los Angeles, California.
5. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
6. LIMITATIONS OF LIABILITY: Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer (including hardware or software) related to or resulting from participation in this Sweepstakes or downloading materials from or use of the website. By entering the Sweepstakes, all entrants agree to release and hold harmless Released Parties from any liability whatsoever for any claims, costs, injuries, liability, losses, actions, or damages of any kind (including, without limitation, related to personal injury, death, damage to property, infringement of proprietary rights, rights of publicity or privacy or defamation) arising out of or in connection with: (1) participation in the Sweepstakes or (2) acceptance, use or misuse of any prize (including any travel or activity related hereto), whether under a theory of contract, warranty, tort, (including negligence, whether active, passive, or imputed) strict liability, product liability, contribution, or any other theory. If for any reason this Sweepstakes is not capable of running as planned, Sponsor in its sole discretion, may disqualify any individual, void entries and/or terminate, modify or suspend this Sweepstakes or any portion thereof. In the event the Sweepstakes is terminated, Sponsor may, at its discretion, conduct a random drawing to award the prize for the drawing at issue from among all eligible, non-suspect entries received for such drawing prior to such action. In the event of a dispute as to the identity of an online entrant, entrant will be deemed the “registered subscriber” of the e-mail account at issue and required to comply with these Official Rules.
